1. Acceptance & eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is greater) to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have full legal capacity to enter into these Terms.

If you use the Service on behalf of an organization — for example, as an employer engaging us to fill a role, or a recruiting firm using our software — you represent that you have authority to bind that organization to these Terms, and “you” refers to both you and the organization.

2. Accounts

You can browse our public job postings and apply to a job without creating an account. Recruiters, employer clients, recruiting firms and their team members who are given Platform access will have an account. To create or use an account you will provide a valid email address, your full name, and a password meeting our security requirements (or sign in with a provider we support).

You are responsible for keeping your sign-in private and for all activity under your account, including activity by team members you invite. Notify us immediately at support@100xrecruiting.com of any unauthorized use. We may suspend or terminate accounts that we reasonably believe have been compromised or are being misused.

You agree that all information you provide — whether in an account, an application, or a resume — is accurate, current, and complete, and you agree to keep it that way. Misrepresentation, including impersonation of another person or fictitious identities, is grounds for immediate termination.

3. Description of the Service

100X Recruiting is a recruiting and staffing service. Depending on what you use, we provide tools and services to:

We may add, modify, or remove features at any time. We will give reasonable notice of any change that materially reduces functionality of a paid feature you currently use.

4. Applying to jobs (candidates)

When you apply to a job posting — by submitting the application form or by using “Apply with LinkedIn” — you submit your name, contact information, resume, and any other materials you choose to provide. By applying, you authorize us to review your candidacy and to share your application materials with the employer hiring for that role (and, where relevant, for other roles you may be a fit for) so they can evaluate you. You represent that the information you submit is truthful and that you have the right to share it.

There is no charge to candidates to apply to a job through the Service. We do not guarantee that applying will result in a response, an interview, or any job offer or employment outcome.

5. Plans, fees & engagements (customers)

Signed agreements. Recruiting fees, placement fees, guarantees, conversion fees, and the terms of any 100X Workforce staffing or payrolling service are set out in a separate written agreement, order form, or statement of work between you and us. That agreement governs those commercial terms; these Terms govern your use of the Platform. If they conflict on a commercial matter, the signed agreement controls.

Plans and purchases on the Platform. Some plans, memberships and credit packs are bought on the Platform, at the prices shown when you buy. Payments are processed by our payment processor, and by submitting payment information you authorize us, through that processor, to charge the payment method on file. You are responsible for any taxes and bank or card fees.

6. Using candidate information (customers)

Candidates appear to employers blinded, without their name or contact details; you see those only after a candidate applies to your job (or records a video for it). If you see candidate profiles through the Platform — through the Client Portal, a membership, or a share link — you agree to:

A candidate’s details opening to you after they apply does not change any fee your signed agreement sets for hiring someone we introduced.

7. Hiring-manager & contact data

Our database and directory contain candidate profiles and hiring-manager contact records compiled from applications submitted to us, from third-party data providers (including, without limitation, third-party people-data, contact-aggregation, and job-listing aggregation services and our applicant-tracking system), and from public sources. Our handling of personal information is described in our Privacy Policy.

If you are given access to contact data through the Platform, you agree that you will not:

We honor opt-out and removal requests. If a candidate or hiring manager asks to be removed, we will remove their record from our database and directory and from any outreach lists that contain it, and you agree to honor any such removal even if you have already accessed the record.

8. Your uploads & connected accounts

You may upload or capture résumés, candidate and contact lists, org charts, job descriptions and other material. You confirm you have the right to give it to us and to have us process it for you, and that collecting it followed the law and the terms of the sites you got it from. Candidates you keep in your Private Resume Storage or your firm’s private workspace are visible only to your organization, except as our Privacy Policy describes. If you connect your own accounts with other services (for example, an email-campaign or email-validation account), you are responsible for those accounts, their costs, and following their terms.

9. AI features

The Service uses AI to write drafts, summarize candidates, read files, score matches and answer questions. AI can be wrong. Review AI output before you rely on it or send it. Match scores and rankings are tools to help people decide; you are responsible for your hiring decisions and for following any law that applies to using automated tools in hiring.

10. The 100X Chrome extension

We give you a limited, non-transferable, revocable license to use the 100X Chrome extension with your account. It works as described in our Privacy Policy. You are responsible for following the terms of LinkedIn, Gmail, Outlook and any other site you use it on, and for the messages you send. Don’t copy, change or redistribute it.

11. Prohibited activities

You agree NOT to:

Violation of these prohibitions may result in immediate suspension or termination of your account or access, and referral to law enforcement where appropriate.

12. Intellectual property

All content, software, and materials made available through the Service — including but not limited to text, graphics, logos, icons, images, audio, video, AI-generated job descriptions, candidate summaries and outreach drafts, the directory schema, and the underlying source code — are the property of Zipapply LLC or our licensors and are protected by United States and international copyright, trademark, and other intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. This license terminates automatically if you breach these Terms.

You retain ownership of the content you submit (resume, application materials, notes, etc.). By submitting content to the Service, you grant Zipapply.com, LLC a worldwide, royalty-free license to host, display, transmit, and process that content for the purpose of operating the Service and presenting your candidacy to prospective employers. We will not sell or license your personal content to third parties for marketing purposes without your consent.

13. Warranties & liability

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. The above limitations apply to the maximum extent permitted by law. If you are a customer, you agree to defend and hold Zipapply.com, LLC harmless from claims arising from material you upload, messages you send, your hiring decisions, or your breach of these Terms.

14. Ending your use

You may stop using the Service at any time; paid plans end as described in section 5. We may suspend or end your access if you breach these Terms or a signed agreement, if the law requires it, or if we stop offering a part of the Service (in which case we will tell you first). Sections 6, 7, 8 and 12 through 15 continue after your access ends.

15. Dispute resolution & arbitration

These Terms are governed by the laws of the State of Georgia, U.S.A., without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.1 Informal resolution

Before filing any formal claim, you agree to first contact us at legal@100xrecruiting.com with a detailed description of the issue. We will work in good faith to resolve the dispute within thirty (30) days.

15.2 Binding arbitration

If we cannot resolve the dispute informally, any claim or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules. The arbitration will be conducted in Forsyth County, Georgia, by a single arbitrator selected under the AAA rules. Judgment on the arbitrator’s award may be entered by any court of competent jurisdiction.

Class-action waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective, consolidated, or representative action.

15.3 Intellectual-property carve-out

Notwithstanding the above, either party may bring claims for injunctive relief related to intellectual-property infringement or misappropriation in the state or federal courts located in Forsyth County, Georgia, and both parties consent to the exclusive jurisdiction of those courts for that purpose.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. For material changes we will give at least thirty (30) days’ advance notice by email or through an in-app notice. Your continued use of the Service after a revision becomes effective constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service before the revised Terms take effect.
